Tilbrook’s ‘Article 50’ Judicial Review
http://robintilbrook.blogspot.com/
The
English Democrats are bringing a High Court case using the Judicial Review
procedure to sue Theresa May and the Secretary of State for Exiting the
European Union (Case No. CO/1322/2019).
We have a strong case that, according to law, the United Kingdom left
the European Union on the 29th March at the expiry of our two year notice
period which was given under Article 50 of the Lisbon Treaty. This case is
therefore the only realistic chance that we have of getting any real Brexit.

I
have been informed that those in charge of the Mail On-line were told by the

Moreover,
the Government was successful in proposing a further amendment in the House of
Commons. The procedure for accepting delegated legislation to modify the
definition of ‘exit day’ no longer requires an affirmative resolution by the
Commons and the Lords. It now uses the negative resolution procedure (section
2).
Expediency
won out: the maintenance of the affirmative resolution procedure might lead to
the frustration of the Bill’s purpose, there perhaps being no time to obtain
votes in order to avoid the UK leaving the EU with no deal on 12 April. Yet, the modification of ‘exit day’ does not
prevent the avoidance of no deal. It provides clarity by preventing
delegated legislation designed to facilitate ‘no deal’, or to deal with
deficiencies in retained EU law, from coming in to force.
....
Moreover,
the move to negative resolution is not just for the one-off motion to prevent
no deal on 12 April. It applies to all future amendments to ‘exit day’: 22 May
(leaving with a Withdrawal Agreement and no European Parliamentary elections);
11 June (leaving with no deal having failed to hold European Parliamentary
elections); 31 October (with or without the ratification of the Withdrawal
Agreement); or the first of July, August, September or October, the Withdrawal
Agreement having been ratified before the end of June, July, August or
September – not to mention the possibility of a further extension request.

https://www.express.co.uk/news/world/60892/Civil-liberties-erosion-slammed (2008)
Civil
liberties watchdog Statewatch slammed the EU's post-9/11 security strategy as a
"frightening" grab for every aspect of individual information.
The
60-page report - published on the seventh anniversary of the terrorist attacks
on New York and Washington - said that the EU now saw data privacy and judicial
scrutiny of police surveillance tactics as obstacles to efficient law
enforcement co-operation, rather than rights to be safeguarded.
The
report, The Shape Of Things To Come, described a so-called EU "Future
Group" preparing a new five-year security strategy as "shadowy",
in its plans to co-operate with the US on "extremely controversial"
techniques and technologies of surveillance and "enhanced"
co-operation.
The
group is accused of trying to harness what itself has called the "digital
tsunami" to aid law enforcement.
The
Statewatch report quotes an EU Council of Ministers documents on justice and
security which declared: "Every object the individual uses, every
transaction they make and almost everywhere they go will create a detailed
digital record. This will generate a wealth of information for public security
organisations, and create huge opportunities for more effective and productive
public security efforts."

Over
60% of this document (Chapters 5 & 6), is focused on the failures of
statements from SCENIHR, the telecommunications industry, the U.S…. to reflect
the science…. the evidence is
inconsistent or conflicting and therefore, in their view, no conclusions can be
drawn. (p2)
The
European Commission has done nothing to protect European citizens from any of
these very
serious
health hazards (p3)
My
own paper on this and two earlier reviews cited in it found that there are
whole series of repeatedly found EMF effects which have also become extremely
widespread complaints in our technologically advanced societies… these findings
are…at levels well within our safety guidelines (p5)
Our
current safety guidelines are based only on heating (thermal) effects.
Therefore, our current safety guidelines are allowing us to be exposed to EMFs
that are approximately 7.2 million times too strong. (p22)
(Ch.
6 Summary) I think we are looking at cumulative severe impact on our brain
function, on our reproductive function and on our DNA, and that these, in turn
will lead to the crash of every single technologically advanced country on
earth, barring a major change in course.
I
consider EU and U.S. views and actions to be shocking. (p79)
In
summary, then, 5G is predicted to be particularly dangerous for each of four
different reasons:
1.
The extraordinarily high numbers of antennae that are planned.
2.
The very high energy outputs which will be used to ensure penetration.
3.
The extraordinarily high pulsation levels.
4.The
apparent high level interactions of the 5G frequency on charged groups
presumably including
the
voltage sensor charged groups.
…many
organisms will be much more impacted than we will. This includes insects and
other
arthropods,
birds and small mammals and amphibia. It includes plants including even large
trees,
(p79/80)
We
have no biological safety testing of genuine 5G radiation. Therefore, we have
no risk analysis or risk management because we have no risk assessment
whatsoever on 5G….But it is not the request for the use of the precautionary
principle that is premature, it is the Commission’s claim that it has
done
the required risk analysis and risk assessment. This is the bizarre world that
we live in.
The
European Commission has done nothing to protect European citizens from the very
serious
health
hazards and the U.S. FDA, EPA and National Cancer Institute have done nothing
to protect
U.S.
citizens. (p81/82)

will utilize not only the frequencies currently in use, but also higher
millimeter wave and sub-millimeter wave frequencies. Small cells being
installed in cities are usually 4G technology with a wide variety of
frequencies. Thus, when we consider the health impacts of 5G and small cells we
are looking at research on current technologies and frequencies in use in
addition to research on sub-millimeter and millimeter waves. The 5G standard is
new …there are no studies that have
looked at long term human exposure to 5G. However the current body of research
finding effects from current wireless technology provides enough data for
scientists to call for a moratorium.

EU
policy and 5G dependence
http://europa.eu/rapid/press-release_MEMO-19-1833_en.htm
Fifth generation (5G)
networks will form the future backbone of our societies and economies,
connecting billions of objects and systems, including in critical sectors such
as energy, transport, banking, and health, as well as industrial control
systems carrying sensitive information and supporting safety systems.
Democratic processes, such as elections, increasingly rely on digital
infrastructures and 5G networks, highlighting the need to address any
vulnerabilities…
Any vulnerability in 5G
networks could be exploited in order to compromise such systems and digital
infrastructure – potentially causing very serious damage or in order to conduct
large-scale data theft or espionage. The dependence of many critical services
on 5G networks would make the consequences of systemic and widespread
disruption particularly serious.
At present, European
companies collectively have about 30 per cent of the 5G market — but they are
more expensive than their competitors. Meanwhile, more than 90 per cent of our
IT devices are made in Asia, notably China, and China controls 70 per cent of
the global supply of the critical raw materials you need to make them… This kind
of dependency creates risks and vulnerabilities.
But ENISA has poked holes in
the high-flying political talk about 5G: fast mobile connections come with a
“medium to high risk” of cybersecurity attacks, according to the Athens-based agency.
Despite the hype over 5G, the
EU cybersecurity agency has cautioned that there are not enough safeguards in
place to make sure the new networks will be secure.
...
Steve Purser, the agency’s
director of operators, told EURACTIV “the current signalling protocols have not
been designed with security in mind, making it impossible at this point to
implement native/efficient security”.

Despite
this availability of early data, the business opportunities still require
further investigation because the digitalization of the many industries in
transformation will significantly disrupt the current business models. A
particularly relevant example is the transformative effect and economic shift
towards new service delivery models (e.g. where "on demand" approaches
will replace long term planned contracts) for which the expected significant
redistribution of revenues streams cannot yet be fully assessed.

Huawei
row: UK to let Chinese firm help build 5G network
https://www.bbc.co.uk/news/uk-48032286
The
Huawei 5G partnership is a threat to the UK's national security
Alan
Mendoza, executive director of the Henry Jackson Society.
http://www.cityam.com/276672/huawei-5g-partnership-threat-uks-national-security
An
article in Chinese law makes it
mandatory for any company to help the Chinese Communist Party in intelligence
gathering if asked.
…
No
Chinese firm can escape the political influence of the country’s government,
because all companies in China are required by law to have an internal
committee comprised of Communist Party members.
…
This
threat has been sufficient to bring action from our allies in the Five Eyes
intelligence partnership.
The
US has barred Huawei from operating
in its 5G space, and secretary of state Mike Pompeo issued the stark warning
about its technology that “if a country adopts this and puts it in some of
their critical information systems, we won’t be able to share information with
them”.
…
Similarly,
Australia has banned companies
“likely to be subject to extrajudicial directions from a foreign government”
from supplying technology equipment.
…
The sheer scope of the 5G
rollout being planned is immense: it is envisioned that the speed and power of 5G
will enable “the inter-connectivity of everything” in our lives. On a micro
level, this will mean households running on a seamless web of domestic
appliances through “the internet of things”.
On
a macro scale, 5G will enable critical
areas of national infrastructure to be managed more effectively.
Big telecoms operators oppose
a Huawei ban, saying such a move could set back 5G deployment in the bloc by
years. In contrast, Australia and New Zealand have stopped operators using
Huawei equipment in their networks.
The industry sees 5G as the
next money spinner, with its promise to link up everything from vehicles to
household devices.

the number at between 312,000 and 400,000.” Again, barely a third of the dodgy
numbers the People’s Vote were putting out…

Could
bots be involved in the petition? Experts say it’s possible
Ilia
Kolochenko, CEO of security firm High-Tech Bridge, believed it could be possible:
‘It’s relatively easy to influence such petitions with automated bots. Even if
sophisticated anti-automation and anti-bot systems can help, they are not a
perfect solution.
‘There
is always a delicate balance between making it easy to vote and protecting the
online petition from malicious actors,’ he told Metro.

Mr
Stewart has provided the most persistent advocacy of the May deal which has
just gone down to the most crushing defeat in the history of the party. The
only Conservative plank for the Euro election was that Withdrawal Agreement and
it was opposed by more than 90% of the voters.
Mr
Stewart thinks 17.4 million people were wrong to vote to just leave. He spent
time in recent weeks telling me I was wrong not to understand the brilliance of
the Withdrawal Agreement. He being a very intelligent man and an important part
of the establishment exudes confidence in the Remain view and seems to think
those of us who disagree lack understanding. He has an old fashioned last
century view of UK politics, defining pro EU Libdem voters as centrists
Conservative need to attract, whilst ignoring the 17.4 m Leave voters. He says
he wants to unite the Conservative party yet he also says he could not serve in
a Boris Johnson led government.

Last
week Boris Johnson, the leading Tory campaigner for Leave, sided with the
treacherous Dominic Grieve against his Beaconsfield constituency party, whose
members voted to deselect him on the very day that we were supposed to be
leaving the EU. For Grieve, Brexit is an act of stupidity, rejecting the majority
both in the country and his constituency for liberty from the Brussels regime.
He has plotted with EU commissioners behind Theresa May's back, yet Boris
supported him over hard-working local volunteers.
Ken
Clarke summed it up recently when he argued that there was now no chance of
Britain being a stable member of the EU. No wonder Nathalie Loiseau – until
recently French Europe Minister, and now an MEP for Emmanuel Macron’s party –
expressed doubts that a second Brexit referendum would reach a different
conclusion from the first. She suggested that it would be better for Britain to
just leave. I expect more and more European capitals will come to a similar view.

The
government’s intention is to show the EU it is ready to leave without a deal
and hence is prepared to walk away from the negotiations if necessary. There’s
no indication yet Brussels is buying it. And with a breakdown in the talks
feeling a lot more tangible following an acrimonious EU leaders’ summit in
Salzburg last week…

The
European Intervention Initiative (EII/EI2) is a French-led initiative set out
by President Macron
in
September 2017 as part of his vision for a “sovereign, united and democratic
Europe”. In order to achieve that ambition he put forward proposals for a
common European intervention force and a common doctrine for action,
independent of the European Union. Ten European countries, including the UK,
are involved in the initiative.
